Terms and Conditions

Welcome to the SS Marketing Mobile Application ("App"). These Terms and Conditions ("Terms") govern your access and use of the App and its related services. By using this App, you agree to comply with these Terms. If you do not agree, please refrain from using the App.

1. DEFINITIONS

For the purpose of these Terms:

• "Company" refers to SS Marketing, having its registered office at:

  F-2102, Ramchandrapura Ind. Area, Sanganer, Jaipur, Rajasthan-302022

• "Application" or "App" refers to the mobile application provided by SS Marketing named "Value Vyapar".
• "User," "You," or "Your" refers to any individual or business entity using the App, including retailers, distributors, and wholesalers.
• "Products" refer to goods or items listed and available for ordering through the App.
• "Services" mean the functionality and features provided by the App, including but not limited to order placement, tracking, and business transactions.
• "Account" refers to a registered user profile created within the App to access and use its services.

2. ELIGIBILITY

To access and use the App, you must:

• Be at least 18 years of age and legally capable of entering into a contract.
• Be a registered retailer, distributor, or wholesaler authorized to conduct trade.
• Provide accurate and complete information while creating an account.
• Not have been previously suspended or removed from using the App due to policy violations.

SS Marketing reserves the right to deny or terminate access if eligibility criteria are not met.

3. ACCOUNT REGISTRATION & RESPONSIBILITIES

• Users must create an account by providing business name, email address, phone number, and GST details (if applicable).
• Users are responsible for maintaining the confidentiality of their account credentials.
• Any unauthorized access must be reported immediately to SS Marketing.
• SS Marketing is not liable for losses due to unauthorized account access resulting from user negligence.

4. USE OF THE APPLICATION

Permitted Use:

By using the App, you agree to:

• Use it solely for lawful business purposes related to product orders.
• Ensure all provided information is accurate and updated.
• Comply with all applicable laws and regulations.

Prohibited Activities:

You must NOT:

• ✘ Engage in fraudulent activities, hacking, or unauthorized access.
• ✘ Copy, modify, distribute, or reverse-engineer any part of the App.
• ✘ Upload or transmit viruses or malicious software.
• ✘ Use the App in a way that infringes SS Marketing's or third parties' rights.

Violation of these terms may result in account suspension or termination.

5. PRODUCT ORDERS & PAYMENTS

5.1 Ordering Process

• Users can browse and place orders for products through the App.
• Orders are subject to verification and approval by SS Marketing.
• Order confirmations will be sent via SMS, email, or within the App.

5.2 Pricing & Payments

• Product prices displayed may include or exclude applicable taxes (GST, VAT, etc.).
• Accepted payment methods: bank transfers, UPI, credit/debit cards, and cash on delivery (if available).
• Payments must be made as per agreed terms. Delays may lead to account suspension.

6. ORDER CANCELLATION, RETURNS & REFUND POLICY

6.1 Cancellation Policy

• Orders can be canceled before processing for dispatch.
• Once dispatched, cancellations will not be entertained.

6.2 Return Policy

• Returns are accepted only for defective, damaged, or incorrect items.
• Return requests must be initiated at delivery in the presence of the delivery personnel.
• Users must provide valid proof (photos/videos) for return approval.

6.3 Refund Policy

• Refunds are processed after returned products are received and verified.
• Refunds will be credited via the original payment method within 5-10 business days.
• Shipping costs are non-refundable unless the return is due to an SS Marketing error.

7. INTELLECTUAL PROPERTY RIGHTS

• All content in the App, including logos, trademarks, text, images, and software, is owned by SS Marketing and protected by intellectual property laws.
• Users may not use, copy, reproduce, or distribute any content without written permission.

8. PRIVACY & DATA SECURITY

• User data will be handled as per SS Marketing's Privacy Policy.
• SS Marketing does not sell or misuse user data for unauthorized purposes.
• Users are responsible for securing their devices when accessing the App.

9. LIMITATION OF LIABILITY

• SS Marketing is not liable for indirect, incidental, or consequential damages arising from App usage.
• We do not guarantee uninterrupted access or error-free functionality.
• Issues caused by third-party services (payment gateways, internet providers, etc.) are beyond our control.

10. TERMINATION OF SERVICE

SS Marketing reserves the right to suspend or terminate user access under the following conditions:

• ✘ Violation of these Terms & Conditions.
• ✘ Engagement in fraudulent or suspicious activities.
• ✘ Non-payment or breach of financial agreements.
• ✘ Actions causing reputational harm to SS Marketing.

Upon termination, access to the account will be revoked, and pending orders may be canceled at SS Marketing's discretion.

11. MODIFICATIONS TO TERMS

• SS Marketing may update these Terms periodically.
• Users will be notified of significant changes via email or in-app notifications.
• Continued use after modifications implies acceptance of the updated Terms.

12. GOVERNING LAW & DISPUTE RESOLUTION

• These Terms are governed by the laws of India.
• Disputes shall be resolved through arbitration in Jaipur, Rajasthan, per the Arbitration and Conciliation Act, 1996.
